THE PROCESS

Precision Over Process.

Complex financial disputes don’t resolve through generic frameworks. They resolve when the essential questions are identified, rigorously analyzed, and honestly confronted by all parties.

SCROLL TO EXPLORE

THE FRAMEWORK

The Questions That Drive Resolution.

Every complex financial mediation ultimately turns on a defined set of questions.

01

Legal Merits

What are the strengths and weaknesses of each party's claims? Where does the law genuinely favor one side, and where is the outcome uncertain?

02

Material Facts

What is established, what remains disputed, and what would proving or disproving contested facts cost or achieve?

03

The Collection Landscape

What assets are genuinely available for recovery? What are the competing claims? What will enforcement actually cost in time, money, and uncertainty?

04

Litigation Economics

What will continued litigation cost not just in fees, but in business disruption, management distraction, business reputation/relationships and opportunity cost?

The Value Question

Is the value of what exists today or in the future from a functioning enterprise, an ongoing relationship, or an intact asset base greater than what any party would recover through enforcement and liquidation?

When the answer is yes, resolution isn't about compromise. It's about preserving value that aggressive litigation might otherwise destroy.

THE RESOLUTION PRINCIPLE

BEFORE THE SESSION

Analytical Rigor Before Day One.

Jeremy reviews all submitted materials with the analytical rigor he applied to cases as a litigator — identifying key legal and factual issues, economic dynamics, financial incentives and constraints, and the questions most likely to drive or obstruct resolution.

Parties are encouraged to submit comprehensive briefs addressing legal merits, relevant facts, and the economic realities of their position. Confidential submissions addressing settlement authority and priorities are welcome and often essential.

Jeremy conducts individual calls with counsel to understand not just legal positions but practical dynamics: what each client needs, what the real obstacles are, and what has been tried before.

DURING THE SESSION

Direct but Never Adversarial.

Sessions are structured around the analytical framework above, adapted to each dispute. The approach is direct but never adversarial.

01

Joint Sessions

When appropriate, establish the framework and ensure all parties understand the questions to be addressed.

02

Private Caucuses

The core work — rigorously testing assumptions, genuine strengths, unconfronted vulnerabilities, and what the economic analysis actually supports.

03

Equal Precision

When appropriate, establish the framework Applying the same analytical precision to every party's position, so everyone works from the same reality. Not splitting differences — finding resolution.

AFTER THE SESSION

Resolution Doesn't Always Happen in a Single Session.

Jeremy remains engaged as positions evolve, new information emerges, or additional analysis is needed. The analytical framework established during mediation creates a foundation for continued dialogue.
